使用條款（EULA）

使用 MurMur Echo（以下稱「本 App」）即表示你同意以下條款。本 App 由 Phoebe Huang（台灣）提供。

1. 服務內容

本 App 是一款日記 App：你寫下的日記會變成空間裡的 MurMur，並可透過 AI 精靈回顧過去的紀錄。部分功能需要網路，例如跨裝置同步、AI 敘事與訂閱。

1. The service

The app is a diary: each entry you write becomes a MurMur in your space, and an AI genie helps you look back over what you have written. Some features need a network connection, such as cross-device sync, AI narratives and subscriptions.

2. Recalls 鑰匙

  • 本 App 不使用帳號密碼。你的空間由三個值（Email、使用者名稱、通行金鑰）組成的 Recalls 鑰匙識別。
  • 這三個值無法修改，也無法找回。遺失任何一個，就無法再打開你的日記，我們也無法協助復原。 請自行妥善保存。

2. Your Recalls Key

  • There is no account or password. Your space is identified by a Recalls Key made of three values (email, username, passphrase).
  • The three values cannot be changed or recovered. If you lose any of them, your diary can no longer be opened, and we cannot help you recover it. Keep them safe.

3. AI 內容

  • AI 精靈產生的內容僅供回顧與參考，可能不正確或不完整。
  • 本 App 不提供醫療、心理諮商或任何專業建議，心情與情緒的判斷由模型自動推估，並非診斷。如果你正處於危機或需要協助，請聯絡當地的緊急服務或專業人員（台灣：安心專線 1925、生命線 1995）。

3. AI content

  • What the AI genie writes is for reflection only and may be inaccurate or incomplete.
  • The app does not provide medical, psychological or any other professional advice. Mood and emotion are estimated automatically by a model and are not a diagnosis. If you are in crisis or need help, contact local emergency services or a professional.

4. 訂閱（MurMur Echo Pro）

  • Pro 以月或年為單位自動續訂，透過 Apple App Store 或 Google Play 付款，價格以商店顯示為準。
  • 除非在目前週期結束前至少 24 小時關閉自動續訂，訂閱會自動續訂並向你的商店帳號收費。
  • 你可以隨時在商店的帳號設定中管理或取消訂閱；取消後，Pro 功能會使用到目前週期結束。
  • 退款依 Apple 或 Google 的政策處理，請向購買的商店申請。
  • 同一個 Email 的訂閱最多可在 2 個空間使用。

4. Subscriptions (MurMur Echo Pro)

  • Pro renews automatically every month or year and is paid through the Apple App Store or Google Play, at the price the store shows.
  • Unless auto-renew is turned off at least 24 hours before the end of the current period, the subscription renews and your store account is charged.
  • You can manage or cancel at any time in your store account settings; after cancelling, Pro stays active until the end of the current period.
  • Refunds follow Apple's or Google's policies; request them from the store you bought from.
  • One email's subscription can be used in up to 2 spaces.

5. 你的內容

你的日記和其他內容屬於你。我們看不到日記內容（見隱私權政策），只會在提供服務所需的範圍內處理資料。

5. Your content

Your diary and other content belong to you. We cannot read your diary (see the Privacy Policy) and process data only as needed to provide the service.

6. 使用規範

請勿以任何方式干擾、攻擊或濫用本服務，包括嘗試存取他人的資料、大量自動化請求，或逆向工程以規避訂閱限制。違反時我們可以暫停或終止服務。

6. Acceptable use

Do not interfere with, attack or abuse the service, including trying to access other people's data, sending automated requests in bulk, or reverse engineering the app to get around subscription limits. We may suspend or end the service for anyone who does.

7. 免責與責任限制

本 App 依「現況」提供。在法律允許的最大範圍內，我們不保證服務不中斷或沒有錯誤，也不對資料遺失（包括遺失 Recalls 鑰匙造成的資料無法開啟）或間接損失負責。我們對你的總責任以你在過去 12 個月內支付給本 App 的金額為上限。消費者依法享有的權利不受影響。

7. Disclaimers and limitation of liability

The app is provided "as is". To the fullest extent the law allows, we do not promise the service will be uninterrupted or error-free, and we are not liable for lost data (including a diary that cannot be opened because a Recalls Key was lost) or for indirect losses. Our total liability to you is limited to what you paid for the app in the previous 12 months. Nothing here limits rights you have as a consumer under the law.

8. 條款變更與終止

條款更新時會修改本頁日期；重大變更會在 App 內通知。你可以隨時停止使用並刪除你的空間。

8. Changes and termination

When these terms change, the date above changes; significant changes are announced in the app. You can stop using the app and delete your space at any time.

9. 準據法

本條款以中華民國（台灣）法律為準據法，並以台灣台北地方法院為第一審管轄法院，但不影響你依所在地消費者保護法律享有的權利。

9. Governing law

These terms are governed by the laws of Taiwan (Republic of China), with the Taiwan Taipei District Court as the court of first instance, without affecting the consumer protection rights you have where you live.

10. Apple 相關條款

如果你從 App Store 下載本 App：本條款是你與開發者之間的約定，與 Apple 無關；Apple 不負責本 App 的維護與支援，也不承擔相關責任；Apple 及其子公司是本條款的第三方受益人，可據以執行本條款。

10. Apple

If you downloaded the app from the App Store: these terms are between you and the developer, not Apple; Apple is not responsible for the app, its maintenance or support, or any claims relating to it; and Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them.
